TERMS AND CONDITIONS

Please note that the following terms and conditions outline the legal agreement between the user ("you") and our fitness subscription website ("we," "us," or "the website"). By accessing or using our website and subscription services, you agree to comply with and be bound by the terms and conditions outlined below:

 

1. Membership and Subscription

1.1. By subscribing to our fitness website, you acknowledge that you are at least 18 years old or have obtained parental consent to use our services. Under 18's will not be provided with set calories to hit, but instead guidance on healthier eating chioces.

1.2. Your membership and subscription to our website are personal to you and may not be transferred or shared with any other person.

1.3. Before subscribing please make sure your country has access to either of these app stores: 'Apple App store' or  'Google Play Store' . Unfortunately, if your country does not have access to these app stores and you have subscribed, you will not be able to access The Gymfella Fitness App and you will lose all access to your subscription.

2. Account Registration

2.1. You must provide accurate and complete information during the registration process.

2.2. You are responsible for maintaining the confidentiality of your account credentials, and you agree to notify us immediately of any unauthorised use of your account.

 

3. Subscription Fees and Recurring Payment

3.1. Subscription fees are outlined on our website and are subject to change with prior notice.

3.2. By subscribing, you authorise us to charge the subscription fees to the payment method provided.

3.3. Subscription fees are non-refundable, except as required by applicable law.

3.4. By subscribing, you will be automatically billed each period.

3.5. Once payment has been made for the subscription, you will be emailed your on-boarding steps. If you do not complete all on-boarding steps, we will not be able to complete your programming and you will be unable to access your app profile.

3.7. If you purchase a new gym plan or a nutrition plan request, and have completed all required questionnaire forms, please allow up to 2-3 working days for your plan to be available. 

3.8. If you fail to make payment for renewal of your subscription, you will automatically lose access to all areas of your subscription resources.

3.9. Any queries sent to the support team (info@gymfella.co.uk) can take up to 3-5 working days to respond. Please view our FAQ section.

4. Content and Intellectual Property

4.1. Our website provides fitness-related content, including articles, videos, and other materials, which are protected by intellectual property laws.

4.2. You may access and use the content solely for personal, non-commercial purposes.

4.3. You agree not to reproduce, distribute, modify, or create derivative works based on our content without our prior written consent.

4.4. The content and promotional tools provided on the website are for promotion only and will differ from the content and programming you will recieve when you subscribe.

5. Cancelation of your Subscription 

5.1. You must give 7 days notice if you wish to cancel your subscription.

5.2. Once you have cancelled your subscription, you will lose all access to your subscription services originally provided.

6. Disclaimer of Liability

6.1. Our website provides general fitness information and resources, but we do not offer medical advice or guarantee specific results.

6.2. You acknowledge and agree that your use of our website and services is at your own risk.

6.3. We shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use or inability to use our website or services.

6.4. Our website’s content and subscription services should not be performed or used without clearance from your physician or health care provider first.

6.5. The website's content and subscription services are not created by medical professionals and nothing on this website should be misconstrued to mean otherwise.

 

7. Termination

7.1. We reserve the right to suspend or terminate your account and access to our website if you violate these terms and conditions.

7.2. Upon termination, you will no longer have access to your account or any content associated with it.

8. EXPECTED RESULTS FROM YOUR SUBSCRITION

8.1. If our services are fully implemented, you should see great results and progress in your fitness goals. However, if our services are not implemented, this may lead to a lack of progress or no results.

8.2. Any transformations or testimonials on our website and subscription service are from individuals who fully implemented our guidance but also used their own discipline and motivation to get the results. 

9. Amendments

9.1. We reserve the right to modify or update these terms and conditions at any time.

9.2. Any changes will be effective upon posting the revised terms and conditions on our website.

9.3. Your continued use of our website after the changes will constitute your acceptance of the updated terms and conditions.
